1. Who we are

thevisionqc is operated by BCKSPCE HOLDING SARL, 247 Impasse des Guinettes, 74210 Doussard, Haute-Savoie, France ("we", "us"). You can reach us at thevisionqc@bckspce.com.

2. What the service does

thevisionqc is a visual quality inspection system. It photographs parts, scores them against a model, and can signal a reject to connected machinery. Accuracy depends on the images and labels you provide: the system learns from your data, and its judgement reflects the quality and quantity of that data.

3. It assists, it does not certify

The service is a decision-support tool. It does not guarantee that every defective part will be detected, nor that every rejected part is genuinely defective. You remain responsible for your own quality assurance, for any regulatory conformity of your products, and for validating that the system performs adequately for your use before relying on it in production.

4. Safety

The software is never part of a machine safety loop. Emergency stop and safety circuits must be implemented in hardware in accordance with the applicable standards (such as ISO 13849) and remain entirely under your control. We supply no functional safety certification, and the software must not be used as a protective measure for persons.

5. Your data

Images, labels and models you create remain yours. We do not use your production images to train models for other customers. Where we host the service on your behalf, we process that data only to provide the service to you.

6. Availability

Where the software runs on your own hardware, availability is in your hands. Where we host it, we aim for continuous availability but do not guarantee uninterrupted operation, and we may take the service down for maintenance with reasonable notice.

7. Liability

To the fullest extent permitted by law, our liability arising from the use of the service is limited to the fees paid for it in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost production, scrapped material, or loss of profit. Nothing in these terms excludes liability that cannot lawfully be excluded.

8. Fees and term

Fees, licence duration and support arrangements are set out in the written agreement or order form between us. Those terms take precedence over this page where they conflict.

9. Termination

Either party may terminate as set out in the agreement between us. On termination you may export your images, labels and trained models; we will delete data we hold on your behalf on request.

10. Governing law

These terms are governed by French law, and the courts of France have jurisdiction over any dispute, without prejudice to any mandatory consumer protection rules that may apply to you.
